This paper examines Law 12/2023 of May 24 on the right to housing (LDV) in light of the most recent rulings by the Constitutional Court. After framing the distribution of powers between the central government and the autonomous communities and reconstructing the previous regulatory context, the constitutional basis of the main measures of the LDV and their connection with state powers are analyzed. It then analyzes the doctrine of SSTC 79/2024 and 26/2025, paying special attention to the scope recognized in these rulings of Article 149.1.1 of the Spanish Constitution (CE) on the right to housing, as well as the substantive assessment of certain measures introduced by the LDV.
