La Universidad Loyola pone a disposición de la comunidad universitaria, así como de instituciones, empresas y sociedad en general, una amplia gama de servicios orientados, por un lado, a facilitar las diversas gestiones académicas que el alumnado debe realizar a lo largo de su vida en la Universidad, y, por otro, que propician el correcto desempeño de las actividades de gestión de la propia institución universitaria.

CONDICIONES DE ACCESO Y UTILIZACIÓN DEL SITIO WEB

1.- Aceptación de las condiciones de uso
El usuario se compromete a hacer un uso adecuado y lícito del sitio Web y de los contenidos recogidos, de conformidad con la legislación aplicable, las condiciones generales vigentes en cada momento, la moral y las buenas costumbres generalmente aceptadas requeridas para utilizar los mismos.
La Universidad Loyola se reserva el derecho a modificar las presentes Condiciones Generales en cualquier momento y sin previo aviso. Por ello el usuario se obliga a revisar las presentes Condiciones Generales cada vez que acceda al PORTAL.

2.- Acceso a la INTRANET
La utilización de las aplicaciones contenidas en la INTRANET está sometida a Condiciones Particulares, que pueden completar y/o modificar las Condiciones Generales que aquí se exponen. Por ello el usuario deberá leer atentamente las correspondientes Condiciones Particulares.
Tanto las Condiciones Generales como las Particulares se completan por los avisos, reglamentos de uso, advertencias e instrucciones que se ponen en conocimiento del usuario de La Universidad Loyola.
En concreto, el usuario se compromete a usar sus claves de acceso (nombre de usuario y contraseña) de acuerdo con las siguientes restricciones:

•  Las claves de acceso son para uso exclusivo del usuario titular de  las mismas y su custodia, confidencialidad y correcta utilización son de su exclusiva responsabilidad. La Universidad Loyola no será responsable por ningún perjuicio en que el usuario o terceros puedan causar como consecuencia de que otras personas utilicen su contraseña, tanto con su conocimiento como sin él.
• La Universidad Loyola se compromete a no divulgar la contraseña utilizada por el usuario a cualquier otra persona, excepto en el caso de que, en estricto cumplimiento de los pertinentes requerimientos judiciales o, en su caso, autoridad legalmente autorizada, le sea exigida.

3.- Prohibición de difusión de los contenidos e información suministrada
Los usuarios se obligan a usar los Contenidos de forma diligente, correcta y lícita y, en particular, se comprometen a abstenerse de:

• Utilizar los Contenidos de forma, con fines o efectos contrarios a la Ley, los usos y al orden público.
• Reproducir o copiar, distribuir, permitir el acceso del público a través de cualquier modalidad de comunicación pública, transformar o modificar los Contenidos, a menos que se cuente con la autorización del titular de los correspondientes derechos o ello resulte legalmente permitido.
• Suprimir, eludir o manipular el copyright y demás datos identificativos de los derechos de la Universidad Loyola o de sus titulares incorporados a los Contenidos, así como los dispositivos técnicos de protección o cualesquiera mecanismos de información que pudieran incluir los Contenidos.
• Emplear los Contenidos y, en particular, la información de cualquier clase obtenida a través de la Página o de los Servicios para remitir publicidad, comunicaciones con fines de venta directa o con cualquier otra clase de finalidad comercial, mensajes no solicitados dirigidos a una pluralidad de personas con independencia de su finalidad, así como a abstenerse de comercializar o divulgar de cualquier modo dicha información.

La Universidad Loyola perseguirá el incumplimiento de las anteriores condiciones así como cualquier utilización indebida de los contenidos presentados en su sede ejerciendo todas las acciones judiciales: civiles y penales que le puedan corresponder.

4.- Introducción de Links, Enlaces, Hiperenlaces o Hipervínculos
Los usuarios que deseen establecer un hipervínculo, enlace o link entre su página web y la Página (en adelante el hiperenlace), deberán obtener la autorización previa de la Universidad Loyola, y cumplir, como mínimo, las condiciones siguientes:

• El Hiperenlace únicamente permitirá el acceso a la Página, pero no podrá reproducirla de ninguna forma.
• No se realizarán manifestaciones o indicaciones falsas, inexactas o incorrectas sobre la Página y los Servicios y, en particular, no se declarará ni dará a entender que la Universidad Loyola ha autorizado el Hiperenlaces que ha supervisado o asumido de cualquier forma los contenidos o servicios ofrecidos o puestos a disposición de la página web en la que se establece el Hiperenlace.
• Excepción hecha de aquellos signos que formen parte del mismo Hiperenlace la página web en la que se establezca el Hiperenlace no contendrá ninguna marca, nombre comercial, rótulo de establecimiento, denominación, logotipo, eslogan u otros signos distintivos pertenecientes a la Universidad Loyola.
• La página web en la que se establezca el Hiperenlace no contendrá informaciones o contenidos ilícitos, contrarios a la moral, a las buenas costumbres generalmente aceptadas y/o al orden público, así como tampoco contendrá contenidos contrarios a la naturaleza y fines propios de la Universidad Loyola o a cualesquiera derechos de terceros. El establecimiento del Hiperenlace no implica en ningún caso la existencia de relaciones entre la Universidad Loyola y el propietario de la web en la que se establezca, ni la aceptación y aprobación por parte de la Universidad Loyola de sus contenidos o servicios.

5.- Utilización de la Página, de los Servicios y de los Contenidos bajo la exclusiva responsabilidad de los Usuarios
Los Usuarios son conscientes de y aceptan voluntariamente, que el uso de la Página de los Servicios y de los Contenidos tiene lugar, en todo caso, bajo su única y exclusiva responsabilidad.
En particular, la Universidad Loyola no garantiza la continuidad, disponibilidad y utilidad del PORTAL, de sus Servicios y Contenidos. Por ello, no responde por los posibles daños y perjuicios de cualquier naturaleza que se pudieran derivar para los usuarios. Todo ello sin perjuicio de lo previsto en las Condiciones Particulares.
La Universidad Loyola tampoco garantiza la ausencia de virus ni de otros elementos que puedan producir alteraciones en el sistema informático de los usuarios o en los documentos electrónicos o ficheros almacenados en él.
La Universidad Loyola no garantiza la licitud, fiabilidad, veracidad, exactitud, exhaustividad y actualidad de los Contenidos.
Por ello, la Universidad Loyola no responde de los posibles daños y perjuicios de cualquier naturaleza que se pudieran derivar para los usuarios, y en particular, aunque no de modo exclusivo, por los daños y perjuicios que puedan deberse a:

•  El incumplimiento de la Ley, la moral, las costumbres generalmente aceptadas y/o el orden público como consecuencia de la prestación de servicios por terceros a través de la Página;
•  La infracción de los derechos de propiedad intelectual y/o industrial, de los secretos empresariales, de compromisos contractuales de cualquier clase, de los derechos al honor, a la intimidad personal y familiar y a la imagen de las personas, de los derechos de propiedad y de toda otra naturaleza pertenecientes a un tercero como consecuencia de la prestación de servicios por terceros a través de la Página;
• La realización de actos de competencia desleal y publicidad ilícita como consecuencia de la prestación de servicios por terceros a través de la página;

PROTECCIÓN DE DATOS DE CARÁCTER PERSONAL.

Loyola cumple con las obligaciones impuestas en el Reglamento (UE) 2016/679 del Parlamento Europeo y del Consejo, de 27 de abril de 2016, relativo a la protección de las personas físicas en lo que respecta al tratamiento de datos personales y demás normativa vigente en cada momento que resulte de aplicación, garantizando la observancia de todas las obligaciones y derechos de los afectados en cuanto al tratamiento de datos personales.
En virtud de lo anterior, para utilizar ciertos servicios los usuarios deben proporcionar a LOYOLA determinados datos de carácter personal, por ello de conformidad con la legislación vigente el usuario consiente y autoriza a LOYOLA al tratamiento sus datos de carácter personal en el ámbito de la misma y entes colaboradoras al objeto de desarrollar todos los aspectos vinculados a la labor de admisión y acceso a los estudios universitarios, académica (docente-investigación), de empleabilidad, antiguos alumnos (Loyola-Alumni), disponiendo en cada uno de los formularios de recepción de datos existentes en el Portal, de la información correspondiente a la identificación del responsable del fichero, finalidades del tratamiento de sus datos, así como a la posibilidad de ejercer los derechos que asisten al usuario como a continuación queda expuesto, todo ello mediante la lectura y previa aceptación de nuestra política de protección de datos, quedando debidamente informados en los términos indicados.
