Resumen El proyecto que se propone pretende realizar un estudio interdisciplinar del tema del discurso del odio, con el objetivo de arrojar luz sobre una materia en la que se aprecia, en los £ltimos a¤os, un grado severo de incertidumbre jur¡dica, as¡ como una creciente problem tica en t‚rminos de seguridad. Los discursos odiosos ponen al Derecho en una situaci¢n comprometida, teniendo que elegir entre la sacrosanta libertad de expresi¢n, piedra angular del sistema democr tico, y otros derechos o valores esenciales para el Estado constitucional, como la dignidad, el honor, el sentimiento religioso, la prohibici¢n de discriminaci¢n, o la seguridad. La respuesta del Derecho ante estos espinosos conflictos, hasta hace poco m s de una d‚cada, se hab¡a regido por unas l¡neas maestras construidas sobre el respeto casi absoluto a la libertad de expresi¢n en el contexto norteamericano, y el apego a la sensibilidad hist¢rica y pol¡tica de cada Estado en Europa, por m s que, en general, en el viejo continente se dejara sentir una protecci¢n m s intensa del honor y de la dignidad que en Estados Unidos. No obstante, la aparici¢n de nuevos fen¢menos y circunstancias, como la guerra contra el terrorismo, la comunicaci¢n en red y el uso de la tecnolog¡a, la globalizaci¢n, la inmigraci¢n el consecuente pluralismo socio-cultural, as¡ como los sistemas multinivel de protecci¢n de derechos, han difuminado las mencionadas l¡neas maestras, poniendo de manifiesto la dimensi¢n transnacional de un problema tradicionalmente abordado en el mbito dom‚stico, la falta de predictibilidad generada por las diferencias entre las resoluciones adoptadas por las distintas instancias de protecci¢n, y la tensi¢n derivada de nuevos problemas que emergen de las nuevas sociedades plurales y tecnol¡gicas. Se aprecia, adem s, en nuestro Estado -pero no s¢lo- una excesiva penalizaci¢n de la lucha contra los discursos odiosos, que confluye con la dif¡cil aplicaci¢n de los delitos previstos al efecto, produciendo a veces la falta de reacci¢n jur¡dica frente a discursos denigrantes y discriminatorios. Frente a este problema detectado, de impredecible y dif¡cil respuesta jur¡dica frente al discurso del odio, el proyecto tratar¡a de realizar un trabajo de clarificaci¢n, categorizaci¢n, y sistematizaci¢n de conceptos, susceptible de alumbrar la resoluci¢n de conflictos jur¡dicos en este mbito. Asimismo, se pretende realizar propuestas en cuanto a respuestas, por parte del Derecho antidiscriminatorio y Administrativo, frente a dichas conductas. Por otra parte, el estudio transcender¡a las fronteras jur¡dicas, abarcando tambi‚n aspectos politol¢gicos en materia de seguridad nacional, mbito en el que tambi‚n pretenden hacerse propuestas o recomendaciones. Todo ello se difundir¡a entre la comunidad cient¡fica, por medio de diversas publicaciones, y la organizaci¢n de un Congreso Internacional, pero tambi‚n tendr¡a un alcance divulgativo de cara a la sociedad, en general, y a los operadores jur¡dicos, en particular, mediante la creaci¢n de un Observatorio online sobre discurso del odio. Por £ltimo, el proyecto generar¡a un impacto indirecto a trav‚s de la actuaci¢n de las entidades p£blicas y privadas que han solicitado asesoramiento, formaci¢n, o que han mostrado su inter‚s en los resultados del mismo. Abstract The project aims to develop an interdisciplinary study of the hate speech, in order to clarify an issue that, in the last years, has presented a high level of legal uncertainty, and increasing problems in terms of security. Hate speech pushes Law into a delicate situation, which is the need to choose between the protection of the sacred freedom of speech, cornerstone of the democratic systems, or other rights and values that are essential in the Constitutional State, such as dignity, honor, freedom of religion, non-discrimination, or security. Law¶ïs reply to these difficult conflicts, until a bit more than a decade ago, more or less observed a number of main lines, based on the almost absolute respect for freedom of speech in the North American context, and the attachment to the historic and political sensitivity of each State in Europe, although generally, in this continent, there was a deeper respect protection of honor and human dignity that in the US. However, new phenomena and circumstances, as the war against terrorism, the information technology, globalization, migration, social and cultural pluralism of societies, and the multilevel systems of human rights protection, have distorted the mentioned main lines. These new elements show the transnational dimension of a problem that has been usually tackled in the national level, as well as the lack of predictability of the Law, resulting from continuous differences between the resolutions adopted by the different courts (inside the States, and regarding regional Courts as well as other State¶ïs Courts). There is also an increasing tension from the new problems taking place in the new plural and technological societies, and from the international terrorism. Besides that, in Spain (but in other States too), Criminal Law plays a too main role in the fight against hate speech, which is aggravated with its difficult application. This circumstance sometimes implies the lack of legal answer to hate speech. The project would try to solve these problems of difficult and non-predictable legal answer to the hate speech, by clarifying concepts, developing categories. Hence, it could be useful to guide the resolution of legal conflicts in this context. It also wants to make proposals to fight hate speech from the Administrative and the Equality Law. Besides, the project would include proposals related to the national security, coming from an analysis since the perspective of the political sciences. The results of the project would be disseminated to the scientific community, through several publications and the organization of an International Congress. They would also transfer to the society, in general, and to the legal operators, in particular, through the creation of an online Observatory on Hate Speech. Finally, the project would generate an indirect impact in society, through the action of public and private entities that have applied for advise, formation, of which have showed interest for the results of the project.
