This paper analyzes the European Media Freedom Act (2024/1083) (EMFA), which addresses two strategic challenges for the EU: combating disinformation within the media sector and protecting the Rule of Law by promoting media pluralism and journalistic independence. Despite lacking extensive competencies in media governance, the EU-within the framework of its powers in the internal market, competition policy, and consumer protection-has adopted a series of provisions, which include the establishment of the European Board for Media Services, the consolidation of a framework for effective cooperation, the protection of anonymous sources, the promotion of public media independence, and increased transparency both in the allocation of public funds for state advertising and in the information available on the ownership structure of private media, among other measures. The study offers a detailed analysis of each of these measures and concludes that, while certain provisions could benefit from further refinement, the regulatory approach is fundamentally sound and constitutes a meaningful step toward addressing structural challenges in the media sector by fostering transparency and cooperation.
