Abstract

On 31 August, the BOE published Royal Decree 657/2013, of 30 August, approving the Organic Statute of the National Commission on Financial Markets and Competition (CNMC), established under the Act 3/2013, of June 4, and bringing together the supervisory functions of the previous independent regulatory agencies in Spain, with the exception of the National Securities Market Commission (CNMV), the Bank of Spain (BE) and the Council of Nuclear (CSN), which will continue to exist and develop its business as usual. The new macro-regulator will be fully operational at the latest on October 5. This article discusses some of the same fundamental issues, such as their background, both in Spain and in comparative law, nature, legal status and independence.
