Abstract |
Over the past decade, the human rights of migrant children, particularly to social protection, have been widely debated, raising questions about whether this right is defined by their status as migrants or as children. This article offers a human rights perspective in the study of unaccompanied migrant children (UMCs). Based on the assumption that the best interest of children must inform UMC regulation and intervention, this study explores the relationship between migrant children\'s fundamental rights and the recognition and fulfilment of these rights in the process of social inclusion. By reviewing the literature and national and international legislation on the rights, care and protection of these children, this study combines a mixed methodology with empirical data from various protection centres in southern Spain. The main results demonstrate a significant association between the disregard for specific human rights and the risk of social exclusion, highlighting how knowledge and active exercise of these rights enhance integration, well-being, a sense of belonging and reciprocity in the host society. This article critically examines the relationship between human rights and children\'s rights, especially in terms of their collision with immigration policy and practice and the condition of migrants. Suggestions for good practices are also presented. |
